Quit Bragging about A War Crime
Assuming no facts not presented here, I think this is, legally, a war crime. Under military law a crew member parachuting from their damaged plane (as opposed to a paratrooper willingly entering battle) is considered helpless and a non-combatant, and may not be attacked. Abusing that status would, imo, constitute a war crime. At the very least, he would forfeit his own protection under military law. (Photo credit in picture)
